Phase 1 of 3 · Legal Hygiene

Texas Workers' Compensation

Most private Texas employers may choose whether to subscribe to workers' compensation coverage, while subscribers and nonsubscribers face different duties and risks after an injury.

Coverage status is the first fact in every Texas workplace injury response.

In plain English

Texas usually lets a private employer choose coverage, but that choice changes benefits, notices, reporting, defenses, and lawsuit exposure after an injury.

What it looks like in business
Before giving an injured worker forms or claims talk, the owner confirms whether the shop is a subscriber, because the next sentence depends on that fact.
Why it matters
Treating a nonsubscriber like a subscriber, or the reverse, can mislead the employee and mishandle a serious claim.

Tex. Lab. Code Title 5

This is HR guidance, not legal advice, and rules change. Check the current text and your own facts before you act on it. When a situation needs a lawyer, Jennifer will say so.

A gray steel filing drawer stands half open under a warm desk lamp, blank folder tabs in a neat row and one folder lifted just above the rest, DFW.
