HR Pursuit

Phase 2 of 3 · Hire, Land, Keep

Texas covenants not to compete

A Texas noncompete must be tied to an otherwise enforceable agreement and reasonably limited in time, geography, and restricted activity, with added rules for certain health professionals.

Tie the promise to an enforceable agreement, then narrow time, place, and activity.

In plain English

A noncompete cannot simply block future work; it must protect a legitimate agreement through restrictions no broader than reasonably necessary.

What it looks like in business
HR and counsel compare the proposed restriction with the employee's actual territory, duties, confidential access, duration, and any special rule covering the profession.
Why it matters
Courts may reform or reject excessive terms, and recent profession specific changes can make an old template unreliable.

Reading it once is not the same as knowing it. Put this term in the daily rotation and let the quiz come back for it.

This is HR guidance, not legal advice, and rules change. Check the current text and your own facts before you act on it. When a situation needs a lawyer, Jennifer will say so.

Knowing the term is the easy half.

Knowing whether it applies to your eight people, on your payroll, this week, is the part owners call about.
